The Texas Tax Code Section 23.51(1) defines qualified open space land to include “land that is currently devoted principally to agriculture use…or land that is used principally as an ecological laboratory by a public or private college or university.”

Properties must meet the following criteria to qualify:
· Be larger than 50 acres for the most effective research opportunities.
· Land must be contiguous if owned by more than one individual or entity.
· The property must be principally used for research conducted by a college or university.

The program follows a structured process to ensure successful research partnerships and compliance with appraisal requirements:
· Evaluate the property to determine suitable ecological studies.
· Identify highly qualified research scientists through resources like www.texasecolab.org.
· Review and evaluate research proposals for alignment with program goals.
· Negotiate and draft agreements between the landowner and participating universities.
· Coordinate and manage all activities of the researchers on the property.
· Obtain liability waivers to protect both landowners and researchers.
· Submit applications and reports to the Appraisal District for land appraisal as an Ecological Laboratory.
